Neither do I.  All I can say is that your scripts all run fine here
using epslatex and all other terminal drivers that I have tried.
I tested with gnuplot 4.2 patchlevel 3 (a.k.a. 4.2.3) but I can think
of no relevant changes to the epslatex terminal since 4.2.0
